1. HOW TO PLAY: Beginning May 22, 2023 and ending September 23, 2023 (or when supply of specially-marked 12 oz. can 12-packs is exhausted, whichever comes first), look for a winning message on specially-wrapped cans inside Pepsi®, Mtn Dew®, Pepsi Zero Sugar® and Starry® 12 oz. can 12-packs. If the message on your specially-wrapped can or game piece matches the one of the messages indicated below, you are entitled to the prize indicated, subject to verification. To receive a free game piece without purchase, send a self-addressed, stamped envelope to: 2023 PURPLE AND GOLD CAN PROMOTION – Game Piece Request, PSG, PO Box 536986, Orlando, FL 32853-6986. Mail-in game piece requests must be postmarked by September 23, 2023 and received by September 30, 2023, to receive a game piece. Any game piece request received after September 30, 2023 is void. Limit one request per stamped envelope and one game piece/game play per request. Envelopes must be hand-addressed. No photocopied or mechanically reproduced game piece requests will be accepted. No responsibility is assumed for lost, late, incomplete, illegible, misdirected or postage-due requests.

2. PRIZE/ODDS: You are not a winner if the 12 oz. can 12-pack of Pepsi, Mtn Dew, Pepsi Zero Sugar or Starry does not have a specially wrapped can with a winning message or if your game piece reveals “Please try again.” A total of thirty-two (32) Grand Prizes are available as follows:

3. REDEMPTION: Refer to winning can or game piece for redemption information. All potentially winning cans/game pieces must be mailed in a small box or a padded envelope (available at your local post office) with sufficient postage to the address listed on the winning can/game piece. Do not mail can in regular letter-style envelope. Before mailing, empty the can. Claim must be postmarked by October 15, 2023 and received by October 22, 2023. A claim postmarked after October 15, 2023 is void. It is strongly recommended that the winning can, or game piece be sent via certified mail, return receipt requested. Make and keep a photocopy of the can/game piece (front and back) for your records. Proof of mailing does not constitute proof of delivery and proof of delivery does not constitute proof of a winning submission. No responsibility is assumed for lost, late, delayed, postage-due, misdirected or illegible mail or damaged, torn or separated mail due to improper packaging of can. The submission of potentially winning can and/or game piece is solely the responsibility of the participant who assumes all risk of loss, damage, destruction, delay and misdirection of the game piece or winning can. Prizes will only be delivered to addresses within NC. Prize will be delivered within two (2) to four (4) weeks after the verification process.

4. ELIGIBILITY/GENERAL TERMS: Game open to legal residents of the U.S., residing in NC who are 18 years or older as of date of participation. Employees of Minges Bottling Group (“Sponsor”), PepsiCo, Inc., Pepsi-Cola Company and its bottlers, and their respective parent companies, affiliates, subsidiaries, bottlers, distributors, suppliers and advertising, promotional or judging agencies (collectively “Sponsor and Promotion Parties”) and immediate family and household members of such employees are not eligible to win. East Carolina University is not a sponsor of this promotion and is not responsible for the outcome or decisions of the Sponsor. No substitution of prize is offered, no transfer of prize to a third party is permitted, and prize may not be redeemed for cash value. Sponsor reserves the right to award prize of equal or greater value in the event the published prize is unavailable. Any portion of the prize not accepted by winner will be forfeited. All other expenses not specifically stated herein in connection with the receipt, ownership or use of prize is solely the prize winner’s responsibility. Void outside NC and wherever prohibited or restricted by law. All federal, state and local taxes on prizes are solely the responsibility of the prize recipient; winners may receive an IRS Form 1099 for the actual value of the prize. All federal, state and local laws and regulations apply. No groups, clubs, newsletters or organizations may participate in this promotion or reproduce or distribute any portion of these rules or game pieces to their members, and anyone who participates in this game through means not permitted by these rules is disqualified. By participating, each entrant agrees to abide by and be bound by these Official Rules and the decisions of the Sponsor, which shall be final.

5. VERIFICATION: A winning can or game piece submitted for redemption become the property of Sponsor and will not be returned. The can or game piece is subject to verification at the sole discretion of Sponsor, and antifraud detection devices may be used to verify the winner. The can or game piece will be void if it fails to pass antifraud detection measures or if found to be photocopied, reproduced, altered, forged, defaced, tampered with, mutilated, stolen, bartered, sold or traded, unissued, unauthorized or illegible in any way. The can or game piece will also be void if defective or if it contains printing or other mechanical or seeding errors, is printed or produced in error or is obtained through unauthorized channels. The prize will not be awarded to the holder of any can or game piece which is determined to be void or otherwise ineligible, and Sponsor shall have no further obligation or liability in respect thereof, except to replace the voided can or game piece with another randomly selected can or game piece where appropriate upon request. No more than the prizes stated in these Official Rules will be awarded, and if there are more prize claims received, Sponsor may suspend prize award until the end of the promotion, and the prize may be awarded via a random drawing from among all persons who have submitted a verified prize claim after prize awards were suspended. Only specially marked 2023 PURPLE AND GOLD CAN INSTANT WIN PROMOTION can/game pieces distributed by Sponsor during the duration of the game will be accepted and may not be combined with those from any other game.

6. TERMINATION: Game ends on September 23, 2023 or when 2023 PURPLE AND GOLD CAN PROMOTION promo game pieces/specially marked packages are exhausted, whichever occurs first.

7. RELEASES: Potential prize winners will be notified by phone and/or email and/or mail once their prize claim has been received at the redemption address and the 2023 PURPLE AND GOLD CAN INSTANT WIN PROMOTION winner may be required to sign and return an affidavit of eligibility and liability/publicity release (where permitted by law) within ten (10) days of notification. In the event a required affidavit and liability/publicity release/guest release is not returned within ten (10) days, prize will be forfeited. Upon forfeiture, no compensation will be given. Winners, by acceptance of a prize, agree to release Sponsor and Promotion Parties and each of their respective employees, officers, directors, agents, bottlers, representatives, parent companies, affiliates, suppliers, distributors and advertising, promotional, or judging agencies from any and all liability, claims, or actions of any kind whatsoever in connection with the receipt, ownership, or use of prize or while preparing for, participating in, and/or traveling to any prize- or promotion-related activity or for any typographical or other error in these Official Rules or in the announcement or offering of prize. Winner must consent to the use of their name, voice, picture, or other likeness or statements in all media without compensation for purposes of advertising, trade, and promotion as determined by the Sponsor, except where prohibited by law. Sponsor makes no representations or warranties of any kind concerning the appearance, performance or safety of the prize awarded.
