2023 MTN DEW® FISHING / BOTTLE SLEEVE OFFER (“Offer”)

Terms & Conditions
OFFER PERIOD: Offer begins at 12:00 a.m. Eastern Time (“ET”) on April 10, 2023, and ends at 11:59 p.m. ET on June 30, 2023, or while supplies last, whichever is sooner (“Offer Period”).

ELIGIBILITY: Offer open to legal residents of the United States residing in Alabama or Mississippi, 19 years of age or older in Alabama, and 21 years of age or older in Mississippi. Employees of Pepsi-Cola Company (“Sponsor”), and the retailers associated with this offer and all of their respective parent/affiliated companies, divisions, bottlers, distributors, suppliers, and advertising/promotional/judging agencies associated with this offer (collectively, “Sponsor and Promotion Parties”) and each of their immediate family members (defined as parents, spouses, siblings and children; whether biological, adopted, step or in-law) and persons living within the same household as such employees (whether related or not) are not eligible to participate

OFFER: The first 1,000 participants that complete a valid submittal will receive one (1) Mtn Dew bottle sleeve.

HOW TO RECEIVE A MTN DEW BOTTLE SLEEVE: To complete a submittal and receive one (1) Mtn Dew bottle sleeve:
1) Purchase any three (3) Mtn Dew brand 20 oz bottles (the “Qualifying Purchase”) at a participating retail location, while supplies last,
2) Next, look for the QR code on 2023 MTN DEW® FISHING OFFER display materials and scan code to be taken to pepsipromos.com/mtndewfishing to enter from your mobile device or simply visit pepsipromos.com/mtndewfishing to enter from your computer.
3) Once on the website, to complete your “submittal,” follow the directions provided to enter your contact information and upload an image of your Qualifying Purchase receipt. Prior to taking a photo of your Qualifying Purchase receipt:
i. Circle the three (3) Mtn Dew 20oz bottle purchase and write your initials next to it.
ii. Ensure the retailer, date, time, and receipt total are visible on the receipt in order for it to be validated.
iii. Receipt must be dated during the Offer Period.

Only the first 1,000 valid submittals will receive a Mtn Dew bottle sleeve. A Qualifying Purchase receipt may only be used once.

Limit of one (1) submittal per receipt and one (1) Mtn Dew Bottle sleeve per person/email address/household throughout the Offer Period.
Once your upload has been verified for eligibility and compliance with these Terms and Conditions, you will receive Mtn Dew bottle sleeve within 4-6 weeks.
Submittals that appear to duplicate any other submittals, in Sponsor’s sole discretion, will be void and only the first submittal (based on time/date) will be considered for the Offer. Submittals generated by script, macro or other automated means or in violation of these Terms & Conditions will be void. In the event of a dispute as to the identity of a person, participant will be deemed the individual named on the account from which the upload was submitted, and such individual must meet all eligibility requirements set forth herein and otherwise comply with these Terms & Conditions. In the event of non-compliance with any requirements specified herein, submittal will be void. Your submittal constitutes your representation of eligibility, consent to participate in offer and consent for Sponsor to obtain, use, and transfer your name, address, and other information for the purpose of offer administration.

LIMITATIONS OF LIABILITY AND RELEASE: No liability or responsibility is assumed by Sponsor, the Promotion Parties, or any of their respective parent companies, subsidiaries, affiliates, officers, directors, employees, governors, owners, distributors, retailers, agents, assignees, advertising agencies, representatives, and agents (“Released Parties”) resulting from participation in or attempt to participate in the Offer or inability to upload or download any information in connection with the Offer. No responsibility or liability is assumed by Sponsor or Promotion Parties for technical problems or technical malfunction arising in connection with any of the following occurrences which may affect the operation of the Offer: Hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online or network communication problems; errors or limitations of any Internet or wireless service providers, servers, hosts or other providers; garbled, jumbled or faulty data transmissions; failure of any online transmissions to be sent or received; lost, late, delayed or intercepted transmissions; inaccessibility of the Website in whole or in part for any reason; traffic congestion on the Internet or the Website; unauthorized human or non-human intervention of the operation of the Offer, including without limitation, unauthorized tampering, hacking, theft, virus, bugs, or worms; or destruction of any aspect of the Offer or loss, miscount, misdirection, inaccessibility or unavailability of an e-mail account used in connection with the Offer. Released Parties are not responsible for any printing, typographical, technical, computer, network or human error which may occur in the administration of the Offer or these Terms & Conditions or in any Offer-related materials. Use of Website is at user’s own risk. Sponsor and Promotion Parties are not responsible for any personal injury or property damage or losses of any kind which may be sustained to user’s or any other person’s computer or Web-enabled device resulting from participation in the Offer.

RELEASE OF LIABILITY: By participating in the Offer and accepting a Mtn Dew bottle sleeve, participants agree (a) to release Sponsor, the Released Parties from any and all claims, damages or liabilities arising from or relating to such participation in the Offer; (b) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this Offer, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs. By accepting a Mtn Dew bottle sleeve, recipients agree that the Released Parties will have no liability whatsoever for, and shall be held harmless by participant against, any liability for injuries, losses, or damages of any kind to persons or property resulting in whole or in part, directly or indirectly, from participation in the Offer or from acceptance, possession, or use of the Offer.

GENERAL: All information submitted online by participant is subject to, and will be treated in a manner consistent with, Sponsor’s Terms of Use and Privacy Policy accessible at: http://policy.pepsi.com/privacy.htm. By participating, you agree (i) to be bound by these terms and conditions and the decisions of Sponsor which are final and binding, and (ii) to release and hold harmless Sponsor, their respective parent companies, affiliates, subsidiaries, divisions and/or advertising or promotion agencies, individuals or entities responsible for the development, printing, distribution and implementation of this Offer, against any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from participation in this Offer. Offer is subject to all applicable federal, state, and local laws. If electing to participate in the Offer using a wireless device, entrants are solely responsible for any such wireless charges. Released Parties are not responsible for injury or damage to entrants’ or to any other person’s computer and/or wireless device related to or resulting from participating in this Offer or downloading materials from or use of the Website.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS OFFER OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS OFFER MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, PEPSICO, INC. WILL DISQUALIFY ANY PARTICIPANT RESPONSIBLE FOR THE ATTEMPT, AND PEPSI-COLA COMPANY AND IT’S RESPECTIVE AGENTS RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY PERSON OR PERSONS RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

Persons who tamper with or abuse any aspect of the Offer, as solely determined by Sponsor will be disqualified. Should any portion of the Offer be, in Sponsor’s sole opinion, compromised by bugs, virus, worms, non-authorized human intervention or other causes, which, in the sole opinion of Sponsor, corrupt or impair the administration, security, fairness or submission of information, Sponsor reserves the right at its sole discretion to cancel, suspend or terminate the Offer.
