OFFICIAL RULES

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT WILL NOT INCREASE AN ENTRANT’S CHANCES OF WINNING. MULTIPLE ENTRY DEADLINES APPLY. STANDARD DATA RATES MAY APPLY.

The Pepsi / Giant Food BBQ and Bahamas Sweepstakes (the “Sweepstakes”) is sponsored by Pepsi-Cola Company, Inc. (“Sponsor”), 700 Anderson Hill Road, Purchase, NY 10577.

1. SWEEPSTAKES PERIOD: The Sweepstakes begins on May 15, 2024 at 12:00:00 AM Eastern Time (“ET”) and ends on June 23, 2024 at 11:59:59 PM ET (“Sweepstakes Period”).

2. ELIGIBILITY: This Sweepstakes is open to legal U.S. residents of DE, MD, VA or the District of Columbia (“DC”), and who are at least 18 years of age at the time of entry. Employees of Sponsor, Giant Food of Maryland, LLC and each of their respective parent companies, subsidiaries, affiliates, advertising and promotion agencies (collectively, “Promotion Parties”) and each of their immediate family members (e.g., spouse, parent, child, sibling, and their respective spouses and the “steps” of each, regardless of where they reside) and persons living in the same household of each, whether or not related, are not eligible to enter or win.

Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions and interpretation, which are final and binding in all matters related to the Sweepstakes. For purposes of the Sweepstakes, an entrant’s residential address and e-mail address will be the physical address and e-mail address submitted at the time of entry.

3. HOW TO ENTER: There are two (2) ways enter:
A) QR Code Entry: During the Sweepstakes Period, look for the QR code on Pepsi display materials in participating Giant Food locations to enter from your mobile device (“Mobile Device”). By scanning the QR Code with your Mobile Device, you will be taken to the URL pepsipromos.com/BBQBattle and advised to follow the on-screen instructions to submit an entry. Once you have provided the required information, click “ENTER.” (a “Sweepstakes Entry”). You cannot enter solely by scanning the QR code. Standard data rates may apply if participating via a Mobile Device. Check with your wireless service provider for details on any applicable charges. Participants are solely responsible for any such wireless charges. Not all wireless carriers may participate. See Section 4 for Sweepstakes Entry deadlines.

B) INTERNET ENTRY WITHOUT SCANNING A QR CODE: Visit the URL pepsipromos.com/BBQBattle and follow the on-screen instructions to submit an entry. Once you have provided the required information, click “ENTER.” (a “Sweepstakes Entry”). Standard data rates may apply if participating via a Mobile Device. Check with your wireless service provider for details on any applicable charges. Participants are solely responsible for any such wireless charges. Not all wireless carriers may participate. See Section 4 for Sweepstakes Entry deadlines.
Limit of one (1) Sweepstakes Entry, regardless of entry method, per person/email address per day throughout Sweepstakes Period. A “day” is defined as a twenty-four (24) hour time-period beginning at 12:00:00 a.m. ET and ending at 11:59:59 p.m. ET. Sweepstakes Entries are valid for the drawings of the First, Second, Third and Grand Prize Drawings.

BONUS GRAND PRIZE ENTRY: To receive one (1) additional entry into the drawing for the Grand Prize you must 1) attend the Giant Food Barbecue Battle event on Pennsylvania Avenue, NW (3rd-7th St.) between 11:00 AM-9:00 PM on June 22, 2024 or 11:00 AM – 7:00 PM on June 23, 2024; 2) look for the Pepsi Bonus Entry locations (they will be provided via the Giant Food Barbecue Battle event map) and take a photo of yourself at the location; and 3) go to pepsipromos.com/BBQBattle and follow the on-screen instructions to upload your photo during the entry process. Photos may only be used once. Limit of ten (10) Bonus Entries per person/email address. Bonus Entries are only valid for the drawing of the Grand Prize and are not valid for the drawings of the First, Second or Third Prizes.

Any Sweepstakes or Bonus Entries (together “entries”) that appear to duplicate any other submitted entries, in Sponsor’s sole discretion, will be void and only the first entry submitted (based on time/date) will be considered for the Sweepstakes. Entries generated by script, macro or other automated means or in violation of these Official Rules will be void. In the event of a dispute as to the identity of an entrant, entrant will be deemed the individual named on the email address from which the entry was submitted, and such individuals must meet all eligibility requirements set forth herein and otherwise comply with these Official Rules. In the event of non-compliance with any requirements specified herein, entry will be void. Your submission of an Entry constitutes your representation of eligibility, consent to participate in Sweepstakes and consent for Sponsor to obtain, use, and transfer your name, address and other information for the purpose of Sweepstakes administration.

4. PRIZES/DRAWINGS: Twenty-two (22) Prizes will be awarded throughout the Sweepstakes Period. See table below for the Entry Periods, Drawing Date, Prizes, Approximate Retail Values (“ARV”) for each Prize and the number of potential winners that will be randomly selected for each Entry Period. Drawings will be conducted by an independent judging organization whose decisions will be final and binding. The odds of winning a Prize depend on the number of eligible entries received during each Entry Period.

Tickets valid only on the dates specified, no alternate dates available. Any expenses such as parking, meals or gratuities not specifically stated above are the responsibility of the winners. Sponsor is not responsible for cancelled, delayed, or rescheduled events. Winner must comply with all venue rules and regulations. Ticket prizes are subject to certain terms and conditions specified by issuer. Winner agrees that the tickets are awarded pursuant to a revocable, nontransferable license that is personal to the winner and may not be sold, resold, auctioned, bartered, assigned, exchanged, placed in commerce, transferred, given away, donated, or otherwise conveyed.

Applicable to Grand Prize: Travel stipend will be awarded to Winner (only) in the form of an AMEX giftcard sent to Winner prior to the travel date. Travel and accommodations are subject to availability and change. Ground transportation, meals, gratuities and all other expenses not specified herein as part of the Grand Prize are solely Winner’s responsibility. All travel is subject to availability, government restrictions and regulations, hotel, airline, airport or other transportation terminal (or other types of transportation) restrictions and regulations. Other restrictions may apply. Selection of airline and overnight accommodations are at Sponsor’s sole discretion. Winner and/or guest must abide by all venue policies. Seating assignments are at the sole discretion of the Sponsor. Prize related tickets are not for re-sale and cannot be sold after awarded. Winner will be required to provide a credit card prior to hotel check-in and is solely responsible for all incidental charges and may be required to sign an additional liability release for the use of the accommodations. Sponsor assumes no responsibility for canceled, delayed, suspended or rescheduled activities (including, but not limited to airline flights) beyond its control. In the event Winner and/or his or her guest misses a scheduled airline flight (through no fault of Sponsor or due to Force Majeure), Sponsor will have no liability for any costs associated with changing or rebooking transportation. Winner must be able to travel on dates specified by Sponsor or Grand Prize will be forfeited. Prize related travel and accommodations are subject to availability and change. Winner and guest must have all necessary identification and/or travel documents (e.g. passport or valid driver’s license) required for travel. Grand Prize Winners and Guests are responsible for obtaining travel insurance (and all other forms of insurance), unless otherwise noted, at their option and hereby acknowledge that Sponsor has not nor will obtain or provide travel insurance or any other form of insurance. Any minor guest (under age of 18) must be accompanied at all times by minor’s parent or legal guardian who must be the Winner. Guest (or if a minor, his/her parent or legal guardian who must be the Winner) must complete and return a Liability/Travel Release prior to any travel arrangements being made. Actual value may depend on city/date/time of departure.

5. WINNER NOTIFICATION: Potential winners will be notified by email and/or phone at the email address or phone number provided upon entry, within approximately two (2) days of the drawing (“Winner Notification”). Winners will be required to respond within forty-eight (48) hours to their Winner Notification, which will be explained in the original Winner Notification. Potential prize winners may be required to sign and return, where legal, an Affidavit of Eligibility and Liability/Publicity Release and IRS W-9 form (collectively “Prize Claim Forms”), within time frame specified in the Winner Notification or on the Prize Claim Forms, or prize will be forfeited and may be awarded to an alternate winner, in Sponsor’s sole discretion. Sponsor is not responsible for suspended or discontinued wireless service or a change in the entrant’s telephone number or email address that may result in a potential winner not receiving the Winner Notification or any other notice or prize. In the event (i) the Winner Notification, or a prize is returned as undeliverable; (ii) the potential winner fails to respond to the Winner Notification as directed; (iii) the potential winner is unable or unwilling to attend on the date specified; or (iv) a potential winner is determined to be ineligible or not in compliance with these Official Rules, that potential winner may be disqualified and the prize will be forfeited and may be awarded to an alternate winner, in Sponsor’s sole discretion. Allow approximately four (4) to six (6) weeks for delivery of physical prizes following the winner verification. Ticket prizes will be sent no later than two (2) days prior to the scheduled event. Prizes will only be delivered to addresses within DE, MD, VA or DC.

Any difference between stated approximate value of prize and actual value of prize will not be awarded. All other costs and expenses not expressly set forth herein shall be solely each winner’s responsibility. Sponsor is not responsible for any undelivered e-mails, including without limitation, e-mails that are not received because of a winner’s privacy or spam filter settings which may divert any Sweepstakes e-mail, including any winner notification e-mail, to a spam or junk folder. Prizes that are unclaimed, unredeemed, or returned as undeliverable will not be awarded.

6. GENERAL: This Sweepstakes is governed by the laws of the United States and of the State of New York, without respect to conflict of law doctrines. Except as determined by Sponsor in its sole discretion, no substitution of prize is offered, no transfer of prize to a third party is permitted, and non-cash prizes may not be redeemed for cash value. Prize winner will be solely responsible for all applicable federal, state and local taxes on prize. Winner may receive an IRS Form 1099 for the retail value of the prize. Sponsor reserves the right to substitute a prize of equal or greater value in the event a prize or any portion of a prize becomes unavailable. Any portion of a prize not accepted by winner will be forfeited. Upon forfeiture for any reason as stated in these Official Rules, no compensation will be given. All federal, state and local laws & regulations apply. Any personal information provided in connection with participation in the Sweepstakes will only be used by Sponsor to notify a potential winner and/or fulfillment of a prize and shall be subject to the Pepsi-Cola Company’s Privacy Policy available at https://www.pepsico.com/legal/privacy.

7. CONDUCT: By participating in this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the Sponsor, which shall be final and binding in all respects. Failure to comply with these Official Rules may result in disqualification. Sponsor reserves the right, at its sole discretion, to disqualify any individual found to be tampering with the play process or the operation of the Sweepstakes; or to be acting in any manner deemed by Sponsor to be in violation of the Official Rules; or to be acting in any manner deemed by Sponsor to be unsportsmanlike or disruptive, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY A USER OR ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS SWEEPSTAKES OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR AND ITS AGENTS RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH PERSON OR PERSONS RESPONSBILE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

8. LIMITATIONS OF LIABILITY: Sponsor and Promotion Parties, and each of their parent, subsidiary and affiliated companies, and all of their employees, officers, directors, agents, contractors, prize suppliers, promotion/advertising/fulfillment agencies associated with this Sweepstakes (collectively the “Released Parties”) assume no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Sweepstakes; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, camera, computers or providers utilized in any aspect of the operation of the Sweepstakes; (d) inaccessibility or unavailability of any network or wireless service, the Internet or website or any combination thereof; (e) suspended or discontinued Internet, wireless or landline phone service; or (f) any injury or damage to entrants or to any other person’s computer or mobile device which may be related to or resulting from any attempt to participate in the Sweepstakes or download of any materials in the Sweepstakes. If, for any reason, the Sweepstakes is not capable of running as planned for reasons which may include without limitation, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes in whole or in part. In such event, Sponsor shall immediately suspend all drawings and prize awards, and Sponsor reserves the right to award any remaining prizes (up to the total set forth in these Official Rules) in a manner deemed fair and equitable by Sponsor, such as by way of example and not by way of limitation, in a random drawing from among all eligible, non-suspect entries received up to the time of the impairment, and Sponsor shall not have any further liability to any entrant in connection with the Sweepstakes. Sponsor may modify and amend these Official Rules as they may appear online from time to time during the Sweepstakes for clarification purposes without materially affecting the terms and conditions of the Sweepstakes. Sponsor makes no representations or warranties of any kind concerning the appearance, performance or safety of any prize awarded.

9. WINNER RELEASES: All entrants, as a condition of entry into the Sweepstakes, agree to release and hold harmless Sponsor and Promotion Parties, and all other Released Parties from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with submitting an entry or otherwise participating in any aspect of the Sweepstakes, the receipt, ownership or use of any prize awarded, or while preparing for, participating in or traveling to or from any prize-related activity or any typographical or other error in these Official Rules or the announcement of offering of any prize. The winner shall bear all risk of loss or damage to their prize after it has been delivered. Except where prohibited by law, winners grant to Sponsor the right to print, publish, broadcast and use worldwide in any media now known or hereinafter known (including without limitation use online at the Website) the winner’s name, address, voice, statement, picture or other likeness, without additional compensation, for public relations, advertising and promotional purposes as may be determined by Sponsor.

10. WINNERS’ LIST: For a list of the winners, send a self-addressed, stamped envelope, postmarked by July 24, 2023, to Pepsi/Giant BBQ and Bahamas Sweepstakes Winners’ List, P.O. Box 536986, Orlando, FL 32853-6986.
